2. Services Description

Fountrix Technologies provides software development, web development, mobile app development, cloud solutions, and related technology services. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. User Responsibilities

When using our services, you agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations

4. Intellectual Property

The services and their original content, features, and functionality are and will remain the exclusive property of Fountrix Technologies and its licensors. Our services are protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

5. Project Deliverables

For custom development projects:

• Deliverables and timelines will be specified in individual project agreements
• Client approval is required at designated project milestones
• Source code ownership transfers to the client upon full payment, unless otherwise specified
• We retain the right to showcase completed projects in our portfolio unless confidentiality is agreed upon

6. Payment Terms

Payment terms will be outlined in individual service agreements. Generally:

• Payment schedules are based on project milestones
• Invoices are due within the timeframe specified in the agreement
• Late payments may result in project suspension
• All fees are non-refundable unless otherwise stated in writing

7. Warranties and Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, timely, secure, or error-free. We do not warrant the results that may be obtained from the use of our services.

8. Limitation of Liability

In no event shall Fountrix Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our services.

9. Confidentiality

We respect the confidentiality of your business information. Any confidential information shared during the course of our engagement will be protected and not disclosed to third parties without your consent, except as required by law.

10. Termination

We may terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use our services will immediately cease.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Mangalore, Karnataka, India.
